To use the patched version the paludis useflag must be set. In this case it is suggested, that the package from gentoo repository is masked, so it won't be unpatched after the next upgrade of the main package. Adding something like: >=sys-devel/binutils-config-1.9-r3::gentoo to the /etc/paludis/package_mask.conf should do the trick.
